In 2011, the Nevada Legislature created a way to transfer your real estate to another without going through probate. The process was to fill out a deed upon death document, record the document with your local recorder’s office, and when you die, your beneficiary in the deed upon death would file a death of grantor affidavit with the local recorder’s office to transfer the property to them.
Presently, the Nevada Legislature has created burdensome notice provisions to creditors and title companies have created extensive requirements to issue title insurance for the transfer of the real property which have almost rendered the idea of transferring property with a deed upon death meaningless.
